Weed Feed: Bills Aimed at Wiping Out Old Pot Convictions, Allowing Medical Marijuana in Schools Await Gov. Brown’s Signature

Two bills that stand to drastically reshape California’s marijuana policies await Gov. Jerry Brown’s signature after passing through the state senate last month.
Assembly Bill 1793, which would allow people with prior pot convictions to have some offenses erased from their criminal history, passed in the California senate on August 22.
The bill was made possible when Californians legalized recreational marijuana in 2016. The Adult Use of Marijuana Act, which passed with 57 percent of the vote, also allowed for the resentencing and removal of prior marijuana convictions.
“This bill would require the Department of Justice, before July 1, 2019, to review the records in the state summary criminal history information database and to identify past convictions that are potentially eligible for recall or dismissal of sentence, dismissal and sealing, or redesignation pursuant to AUMA,” the bill reads. “The bill would require the department to notify the prosecution of all cases in their jurisdiction that are eligible for recall or dismissal of a sentence, dismissal and sealing, or redesignation.”
Another piece of legislation sitting on Gov. Brown’s desk would allow K-through-12 students to take prescribed medical marijuana on school grounds.
Senate Bill 1127, which was passed by the state senate last week, would no longer require young medical marijuana patients to leave school in order to take their medications.
CBS Sacramento reports that while the bill allows schools to create their own policies in which a parent or guardian could come on school grounds to administer the medical marijuana to their children, the bill does not force schools to accommodate a place for students to use medical marijuana.
Smokeable or vapeable forms of marijuana of any kind are still banned from school grounds.
Gov. Brown has until Sept. 30 to sign or veto the laws. If no action is taken by the end of the month, both laws will automatically take effect.
