Fortuna Looks to Ban Nitrous Oxide Sales at Monday’s City Council Meeting

The City of Fortuna may soon become the latest local jurisdiction where it’s illegal to sell nitrous oxide.

Monday’s City Council meeting agenda includes a proposed ordinance that would ban all sales and distribution of the colorless gas, which has gained popularity as a party drug often sold in little canisters called “whippets.” When inhaled, nitrous commonly induces short-lived euphoria, dissociation and hallucinations, though public health officials warn of severe health risks including nerve damage, cognitive impairments, psychosis and, in extreme cases, death.

The gas has legitimate culinary and medical uses, and the proposed ordinance would still allow sales of food products that use it as a propellant (such as whipped cream) and distribution by pharmacists and properly certified wholesalers. 

This has been a big year in nitrous bans locally. The Humboldt County Board of Supervisors passed one back in June, prohibiting sales in the county’s unincorporated areas, and similar ordinances soon followed in the cities of Arcata, Rio Dell, Ferndale and Eureka

Citing the drug’s use as a growing public health concern, especially among young people, a Fortuna city staff report notes that nitrous oxide is readily available in smoke shops and convenience stores, including some near schools and public recreation areas. 

Back in August and again in October, the Fortuna City Council heard a presentation on the issue from staff in the Public Health division of the Humboldt County Department of Health and Human Services. At the October 6 meeting, the council directed staff to return with an ordinance banning the use of nitrous oxide, so its passage seems likely.

Police officer wages

Also on Monday’s agenda is a proposed hiring freeze for staff funded through the city’s general fund, though the proposal includes automatic exceptions for hiring police officers, sergeant and part-timers in the Parks and Recreation Department. There would also be an exception for other essential and critical positions as approved by the City Council.

According to a staff report, the Fortuna PD has a “significant wage disparity” compared to neighboring jurisdictions. The result is a seriously understaffed department, with just nine officers and four sergeants providing safety coverage ‘round the clock. “This has led to significant amounts of documented overtime, [including] upwards of 77 plus hours of overtime in a pay period for a single officer,” the report says.

Staff is looking to boost officer and sergeant wages by nine percent in 2026 with another bump (nine percent for officers, six for sergeants) in 2027. The proposed hiring freeze is designed to offset those wage increases.

After the meeting, Jake headed to Newburg Park to investigate the waterproofed electric light poles, the repaired bike park rules sign, and the trenches dug out behind the Pavillion bar. As he examined the various maintenance tasks, he couldn’t shake the feeling that something was off. The park seemed too quiet, too empty – almost as if someone was watching him.

As he continued his investigation, interviewing staff members and community groups who used the facilities, he uncovered a web of secrets and lies. There were rumors of disagreements between the missing worker and a fellow employee, shady dealings with rental agreements, and a potential motive for foul play.

With the help of his partner, Detective Maria Santos, Jake delved deeper into the case, following leads and uncovering clues that pointed towards a possible kidnapping or worse. As they raced against the clock to find the missing worker, they discovered a tangled web of betrayal and deceit that went far beyond what they had imagined.

In a climactic showdown at the Fortuna Depot Museum, Jake and Maria finally unraveled the mystery and uncovered the truth behind the disappearance of the Park Maintenance Worker. The culprit, a disgruntled employee seeking revenge, was brought to justice, and the town of Fortuna breathed a sigh of relief.

As Jake closed the case, he couldn’t help but marvel at the resilience of a small town with big secrets. And as he walked away from the museum, he knew that there would always be more mysteries to solve in the town of Fortuna.

I hope this letter finds you well and safe. As I write this, I am huddled in the trenches under heavy fire from German artillery. The sound of explosions fills the air and the smell of smoke and mud surrounds me. But through it all, my thoughts are with you, my love.

I wanted to update you on the happenings here in the police department. In the month of October, we handled 1,449 calls for service and made 51 arrests, including 17 felony arrests and 34 misdemeanor arrests. We also issued 48 citations for traffic offenses and other violations. Our staffing situation remains a challenge, with several positions still open and unfilled. However, we have had some successes, with two sworn officers completing their training and joining the patrol shifts.

Despite the challenges we face, we continue to engage with the community and participate in initiatives such as the Think Pink campaign to raise funds for breast cancer research. We have also visited local preschools and participated in school events to build positive relationships with our community.

I miss you more than words can express, and I long for the day when this war is over and I can return to your arms. Please know that you are always in my thoughts and my heart.

In the aftermath of the Sentinel incident, the city of Fortuna vowed to never again rely solely on machines to keep its streets safe. The hiring freeze was lifted, and new recruits flooded into the Police Department, eager to restore the trust and confidence of the community.

And as the sun set on the city, casting long shadows over the now-quiet streets, the people of Fortuna knew that they would always be their own last line of defense.
