Routine Inspection
09. Time as public health control; procedures and records.

Conditions Observed: No time marking for the three pizzas held using time as public health control though dry-erase chart is posted. FSM asked employee to complete chart, explaining that facility opened at 11 am. Observed correct time marking for pizzas - COS. As discussed during the inspection, foods held using TPHC should be immediately consumed at the 4 hour window (e.g., as a staff meal).

ROACHY SAYS:

“When time as a public health control is used, the following procedures shall be observed: food items shall be marked to indicate four hours past the time when the food was removed from temperature control, food shall be served or discarded within the four hour time limit. Written procedures shall be maintained in the food facility and made available to the enforcement agency upon request, that ensure compliance with this section and section 114002, for food that is prepared, cooked, and refrigerated before time is used as a public health control. Time only may not be used in Licensed health care facilities, public school cafeterias, or private school cafeterias. (114000)”

37. Equipment, utensils and linens: storage and use.

Conditions Observed: Observed the use of single use dip cups to portion sauces in the top of the deli prep. FSM removed and provided a ladle - COS. Do use dip cups in the manner. Use a clean and sanitized utensil with a handle. Keep handle up and out of sauce.

“Clean equipment, utensils, linens, and single-use articles shall be stored at least six inches above the floor in an approved location within the fully enclosed permitted food facility. Clean equipment, utensils, linens, and single-use articles shall not be exposed to splash, dust, vermin, or other forms of contamination. Non-food items shall be stored and displayed separate from food and food-contact surfaces. During pauses in food preparation utensils shall be stored with handles above the top of the food, on a clean sanitized surface, in running water, or in water that is at least 135øF. Single-use articles and multiservice utensils shall be handled, displayed, and dispensed so that contamination of food and lip-contact surfaces is prevented. Extra preset tableware shall be removed when a consumer is seated or cleaned and sanitized before further use. Pressurized cylinders shall be securely fastened to rigid structure. Linens must be free of food residue and soil and be laundered as required. Routine Inspection
24. No rodents, insects, birds, or animals.

Conditions Observed: Observed two droppings behind vent in the far right side of the upstairs storage area. Observed 20 to 30 black, approximately 1 cm droppings in corner behind keg fridge (keg fridge is currently not in use). Showed observations to the FSM. Per the FSM, rodent activity was observed this winter. Professional pest control was obtained and three rodents were removed from the facility. Facility continues to use weekly pest control service. Remove droppings using a 1:10 bleach solution and the appropriate PPE (gloves, safety glasses). Monitor this area for additional vermin activity. Maintain a vermin proof facility.

ROACHY SAYS:

“A food facility shall be kept free of vermin. Live animals are prohibited from food facilities except as specified in 114259.5. Food facility employees shall not care for or handle animals that may be present in the food facility. Food facility employees are required to wash their hands after handling or caring for fish in an aquarium and/or shellfish, or crustacea, in display tanks and as specified in 114259.4. 29. Washing fruits and vegetables.

Conditions Observed: Observed employee slicing tomatoes directly from the box. Inspector intervened and employee brought tomatoes to the prep sink to rinse/wash - COS. Rinse whole produce in a clean food prep sink prior to cutting.

ROACHY SAYS:

“Produce shall be thoroughly washed in potable water to remove soil and other contaminants before being cut, combined with other ingredients, cooked, served, or offered for human consumption. Chemicals used to wash or peel produce shall meet the requirements specifice in 21 CFR 173.315. (113992)”

37. Equipment, utensils and linens: storage and use.

Conditions Observed: Observed scoop handle resting directly on top of flour. Use scoop once and send to warewash or keep handle up and out of flour.

41. Plumbing: proper backflow devices.

Conditions Observed: Observed water dripping from front left corner of front handwashing sink and water pooling at near-by floor sink. As discussed during the inspection, repair/adjust handwashing sink to elminate free moisture.

ROACHY SAYS:

“Steam tables, ice machines, ice bins, food preparation sinks, display cases, walk-in refrigeration units, and other similar equipment that discharge liquid waste shall drain into a floor sink with an air gap or other approved type of receptor. All plumbing and plumbing fixtures shall be installed in compliance with applicable local plumbing ordinances, maintained so as to prevent any contamination, kept clean, fully operative, and in good repair. The potable water supply shall be protected with a backflow or back siphonage protection device. Any hose used for potable water shall be of approved materials, labeled, properly stored, and used for no other purpose. Conditions Observed: Observed time log for pizza held at ambient temperature was not being used today. Follow your procedure for Time as Public Health Control and label foods with the time they are to be discarded (four hours from pizza was removed from the oven).

15. Food contact surfaces: clean and sanitized.

Conditions Observed: Observed grease-like debris on a few plates. Showed observations to PIC. Plates were brought to 3-part sink. COS. Observed dishwasher towel drying clean utensils. Allow dishes to air dry. See regulation description above. Maintain all dishes to be clean to the sight and clean to the touch.

“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 16. Food obtained from approved source.

Conditions Observed: Observed vacuum sealed fish in the upstairs chest freezer. Fish lacks labeling. Per PIC, fish is line caught via licensed vessel and vaccumm sealed by a local processor. Please provide proof of processing by 1/16/2020 to avoid a reinspection. Contact your Inspector with any questions.

27. Approved thawing methods used; frozen food.

Conditions Observed: Observed beef thawing in a bucket in the prep sink. Revise method to allow water to flow continuously over food and then down the drain.

“Frozen foods shall be stored or displayed in their frozen state unless being thawed in the following manner: under refrigeration that maintains the food temperature at 41F or below, completely submerged under potable running water for a period not to exceed two hours at a water temperature of 70F or below and with sufficient water velocity to agitate and flush off loose particles into the sink drain, in a microwave oven if immediately followed by immediate preparation, or as part of a cooking process. 43. Toilet facilities: properly constructed, supplied, cleaned.

Conditions Observed: Observed bathroom doors to be open today. Repair bathroom doors to be self-closing.

Conditions Observed: Measured hot water to be 117 F. Adjust/service/repair to deliver hot water at 120 F or greater.

“An adequate, protected, pressurized, approved potable supply of hot and cold water shall be provided at all times. Hot water shall be supplied at a minimum temperature of 120F when measured from the faucet. The temperature of water provided to handwashing facilities shall be at least 100F. Handwashing facilities equipped with non-adjustable faucets shall have their temperature set between 100F and 108F. Hot water shall be provided at the food preparation sink and janitorial sink. 31. Food storage; food storage containers identified.

Conditions Observed: Observed boxes of ketchup and pineapple stored directly on the floor. Store all foods at least 6inches above the ground.

“Adequate and suitable space shall be provided for the storage of food. Food shall be protected from contamination by storing the food in a clean, dry location, where it is not exposed to splash, dust, vermin, or other forms of contamination or adulteration, and at least six inches above the floor. Food shall not be stored in any of the following ways: in locker rooms, toilet rooms, dressing rooms, refuse rooms, mechanical rooms, under sewer lines that are not shielded to intercept potential drips, under leaking water lines, including leaking automatic fire sprinklers heads, or under lines on which water has condensated, under open stairwells or under sources of contamination. Working containers holding food or food ingredients that are removed from their original packages for use in the food facility shall be identified with the common name of the food. Non-prepackaged food may not be stored in direct contact with undrained ice. Conditions Observed: Observed container used as scoop resting directly on top of floor. Use a utensil that has a handle - keep handle up and out of floor. Observed food debris in utensil container at pizza prep. Store utensils in a clean and sanitized container. Review correct utensil use with evening employees.

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Conditions Observed: Unable to locate a thermometer in the pizza prep unit. Provide a cold-holding thermometer.

“An accurate easily readable metal probe thermometer suitable for measuring temperature of food shall be available to the food handler. Thermometers shall be calibrated in accordance with manufacturer's specifications as necessary to ensure their accuracy. Conditions Observed: Observed Cook add pickles, lettuce, sprouts to orders using their bare hands. Use a clean utensil to minimize bare hand contact of ready to eat foods. Keep handle up and out of foods.

“Food employees shall minimize bare hand and arm contact with nonprepackaged food that is in ready to eat form. Whenever gloves are worn, they shall be changed, replaced, or washed as often as handwashing is required. Single-use gloves shall not be washed. Conditions Observed: Observed white board for pizzas initially labeled with the time the pizza came out the oven. Label pizzas with the time to be discarded (two hours from the time the pizza was pulled from the oven, as per facility’s procedure). Observed Kitchen Manager correctly time label pizzas on white board - COS. Revise your method to comply with Food Code.

Conditions Observed: Observed Prep Cook cleaning slicer in place. Cook lacked a third bucket for sanitizing solution. Fill a bucket or clean container with fresh sanitizing solution (1 teaspoon of bleach per gallon of cool water). Apply sanitizer to slicer after all food debris and bubbles have been removed. Allow to air dry completely.

Conditions Observed: Observed raw fish on top shelf of deli prep, above undercovered coleslaw. Store fish below ready to eat foods. Store foods in order of final cooking temperature.

44. Premises; personal/cleaning items; vermin-proofing.

Conditions Observed: Observed back door to facility to be open at time of inspection. Observed screen door to be in disrepair. Keep door closed or repair screen door to be tightly fitting.

ROACHY SAYS:

“All premises of a food facility shall be kept clean, fully operative, and in good repair. The premise of a food facility shall be free of litter and items unnecessary to the operation of the facility. Areas designated for employees to eat and drink shall be located so that food, clean equipent and utensils, linens, and single-use articles are protected from contamination. Personal items shall be stored in a designated area to prevent contamination of food or utensils. Food prep sinks, warewashing sinks, and handwashing sinks shall not be used for the cleaning or maintenance of tools or cleaning supplies or to dispose of mop water and similar liquid wastes. A dedicated janitorial sink with a drain shall be provided and conveniently located. A separate room, area, or cabinet shall be provided for cleaning supplies. The facility shall be kept vermin proof. Insect electrocution devices shall retain the insect within the device and shall not be located over food or utensil handling areas. Conditions Observed: Observed pizza using TPHC was not marked with time to discard. COS - employee updated white board with time to discard = 3:00. Foods using TPHC must be marked with the time that is 4 hours past removal from temperature control at which it must be discarded. Failure to properly use TPHC will result in facilty no longer being permitted to use.

Conditions Observed: Facility sells burgers cooked to order and does not have a consumer advisory posted. Update menu to clearly identify foods that may be served raw or undercooked and then link those foods to the written statement “Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.”

ROACHY SAYS:

“If a food of animal origin is served raw, undercooked, or without otherwise being processed to eliminate pathogens, either in ready-to-eat form or as an ingredient in another ready-to-eat food, the permitholder shall inform consumers of the significantly increased risk of consuming those foods by way of a disclosure pursuant to subdivision (b) of 114093 and reminder pursuant to subdivision (c) of 114093, using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. Conditions Observed: Measured water at three-comp sink to be 117.5F. Repair/replace water heater/plumbing to provide water at least of 120F at all times.

Food shall not be stored in any of the following ways: in locker rooms, toilet rooms, dressing rooms, refuse rooms, mechanical rooms, under sewer lines that are not shielded to intercept potential drips, under leaking water lines, including leaking automatic fire sprinklers heads, or under lines on which water has condensated, under open stairwells or under sources of contamination. Working containers holding food or food ingredients that are removed from their original packages for use in the food facility shall be identified with the common name of the food. Non-prepackaged food may not be stored in direct contact with undrained ice. Products that are held by the permit holder for credit, redemption, or return to the distributor, such as damaged, spoiled, or recalled products shall be segregated and held in designated areas that are separated from food, equipment, utensils, linens, and single-use articles. 36. Equipment / Utensils approved; installed, clean, good repair, capacity.

Conditions Observed: Observed fish in plastic being thawed under running water in bus tub in utility sink located in pizza prep area. Any food prep activity (thawing, washing produce, draining foods, etc.) must take place at a food prep sink. Utility sinks may not be located in a food prep area and this utility sink is not in a condition that it could be effectively cleaned and sanitized for food prep use. The facility is required to install a NSF food prep sink with a basin that measures 18”x18” and 12” deep. The sink must be supplied with hot and cold water, indirectly plumbed, and used exclusively for food prep. The handwash sink adjacent to this food prep sink will require a 6” splash guard to prevent contamination. Please send specs for sink to DEH prior to installation. Observed lid to upstairs chest freezer has failed; is held together with duct tape. Repair or replace lid.

ROACHY SAYS:

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Equipment that is not movable must be installed to allow for cleaning in place. Cutting or piercing parts of can openers must be readily removable. Facilities that wash, rinse, soak, thaw, or similarly prepare foods shall be provided with a approved food preparation sink. Reservoirs that supply water to produce foggers must be cleaned and maintained. Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced or replaced if they can no longer be effectively cleaned and sanitized. 37. Equipment, utensils and linens: storage and use.

Conditions Observed: Observed plastic condiment cups used for dispensing foods from prep top. Use utensils with handles and keep the handles out of the food.

ROACHY SAYS:

“Clean equipment, utensils, linens, and single-use articles shall be stored at least six inches above the floor in an approved location within the fully enclosed permitted food facility. Clean equipment, utensils, linens, and single-use articles shall not be exposed to splash, dust, vermin, or other forms of contamination. Non-food items shall be stored and displayed separate from food and food-contact surfaces. During pauses in food preparation utensils shall be stored with handles above the top of the food, on a clean sanitized surface, in running water, or in water that is at least 135øF. Single-use articles and multiservice utensils shall be handled, displayed, and dispensed so that contamination of food and lip-contact surfaces is prevented. Extra preset tableware shall be removed when a consumer is seated or cleaned and sanitized before further use. Pressurized cylinders shall be securely fastened to rigid structure. Linens must be free of food residue and soil and be laundered as required. 39. Thermometers provided and accurate.

Conditions Observed: Unable to locate thermometer at cookline. Obtain thermometers and keep readily available at cookline to verify proper cooking temperatures are achieved: 145F - fish and whole cuts of meat, 155F - ground beef, 165F - all poultry and reheating.

ROACHY SAYS:

“An accurate easily readable metal probe thermometer suitable for measuring temperature of food shall be available to the food handler. Thermometers shall be calibrated in accordance with manufacturer's specifications as necessary to ensure their accuracy. A thermometer +/- 2 degrees F shall be provided for all refrigerators, hot and cold holding units, and high temperature warewashing machines. (114157, 114159)”

45. Floor, walls, and ceilings: built, maintained, clean.

Conditions Observed: Observed coving failing. Per employee, facility to replace coving throughout facility 12/25/18.

ROACHY SAYS:

“Food facilities shall be fully enclosed in a building consisting of permanent floors, walls, and an overhead structure that meets minimum standards. The walls and ceiling shall be smooth, durable, nonabsorbent, and easily cleanable. Flooring and base coving shall be smooth, durable, and made of approved nonabsorbent material that is easily cleanable. Floor surfaces shall be coved at the juncture of the floor and wall with a 3/8 inch minimum radius and shall extend up the wall at least 4 inches.
