Conditions Observed: Facility lacks a Food Safety Manager (FSM). Designate an employee to enroll in the next available FSM training. Provide a copy of your FSM certificate to DEH within the next 60 days. No food cards available for review today. Keep food cards for all employees on file at the facility. Be able to make file available to your Inspector upon request.

15. Food contact surfaces: clean and sanitized.
Conditions Observed: Measured QT in the sani-bucket on the cookline to be 100 PPM. Adjust QT to be 200 PPM. Measured QT at the end of the inspection to be 400 PPM. COS.
ROACHY SAYS:
“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 17. Compliance with shell stock tags, condition, display.
Conditions Observed: Shell stock tags are disorganized and lack an in/out date. Store all shell stock tags in chronological order. Label each tag with the date it was opened and the date the last stock was sold.

“Shellstock shall be obtained in containers that bear legible source identification tags. A food facility shall ensure that shellstock from one tagged or labeled container are not commingled with shellstock from another container with different certification numbers. Shellstock tags shall remain attached to the container that they are received in until the container is empty. The identity of the source of the shellstock sold or served shall be maintained for 90 days from the dates of harvest by using an approved recordkeeping system that keeps the tags or labels in chronological order correlated to the date or dates the shellstock is sold or served. The source of the shellstock on display shall be identified. Shellstock that are portioned or prepackaged shall have a copy of the corresponding shellstock tag. Except in accordance with an approved HACCP plan, molluscan shellfish life-support system display tanks shall not be used to display shellfish that are offered for human consumption. “If a food of animal origin is served raw, undercooked, or without otherwise being processed to eliminate pathogens, either in ready-to-eat form or as an ingredient in another ready-to-eat food, the permitholder shall inform consumers of the significantly increased risk of consuming those foods by way of a disclosure pursuant to subdivision (b) of 114093 and reminder pursuant to subdivision (c) of 114093, using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. 28. Food separated and protected.
Conditions Observed: Observed basil leaf touching packaged raw beef. Seperate ready-to-eat foods from raw meats. Observed container of pooled egg resting on top of chopped veggies in the Bev-air fridge. Store pooled egg below or away from ready-to-eat foods.
ROACHY SAYS:
“Food shall be protected from contamination during transportation, storage, preparation, holding, and display. Adequate and suitable counter space shall be provided for all food preparation. Food preparation shall be conducted wthin an approved food compartment or fully enclosed food facility. Open-air barbecues shall be separated from public access. Conditions Observed: Observed onions resting against a container of gasoline. Store gasoline away from food and in a safe location per all applicable law.
ROACHY SAYS:
“Only those insecticides, rodenticides, and other pesticides that are necessary, bear a legible manufacturer's label, and are specifically approved for use in a food facility may be used in a food facility in accordance with the manufacturer's instructions. Containers used for storing poisonous or toxic materiails such as cleaners and sanitizers taken from bulk supplies shall be clearly and individually identified with the common name of the material. Poisonous or toxic materials shall be stored or displayed to prevent contamination of food, equipment, utensils, linens, and single-use articles. (114254, 114254.1, 114254.2)”

Conditions Observed: Observed whole fish stored in trash bag. Move fish to an approved food grade bag or storage container. Observed ice stored in a picnic cooler. Keep ice in a clean and sanitized food grade container.

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Equipment that is not movable must be installed to allow for cleaning in place. Cutting or piercing parts of can openers must be readily removable. Facilities that wash, rinse, soak, thaw, or similarly prepare foods shall be provided with a approved food preparation sink. 41. Plumbing: proper backflow devices.
Conditions Observed: Tail pipe to hub drain serving food prep sink has inadequate air gap. Increase air gap to a minimum of one inch. Walkin cooler is draining to a bucket; adjust so liquid waste drains indirectly to a floor sink or similar approved discharge location.
ROACHY SAYS:
“Steam tables, ice machines, ice bins, food preparation sinks, display cases, walk-in refrigeration units, and other similar equipment that discharge liquid waste shall drain into a floor sink with an air gap or other approved type of receptor. All plumbing and plumbing fixtures shall be installed in compliance with applicable local plumbing ordinances, maintained so as to prevent any contamination, kept clean, fully operative, and in good repair. The potable water supply shall be protected with a backflow or back siphonage protection device. Any hose used for potable water shall be of approved materials, labeled, properly stored, and used for no other purpose. Conditions Observed: Observed 4 by 6 opening in the fascia in the back dry storage area. Repair to eliminate opening and to maintain a vermin proof facility.
ROACHY SAYS:
“All premises of a food facility shall be kept clean, fully operative, and in good repair. The premise of a food facility shall be free of litter and items unnecessary to the operation of the facility. Areas designated for employees to eat and drink shall be located so that food, clean equipent and utensils, linens, and single-use articles are protected from contamination. Personal items shall be stored in a designated area to prevent contamination of food or utensils. Food prep sinks, warewashing sinks, and handwashing sinks shall not be used for the cleaning or maintenance of tools or cleaning supplies or to dispose of mop water and similar liquid wastes. A dedicated janitorial sink with a drain shall be provided and conveniently located. A separate room, area, or cabinet shall be provided for cleaning supplies. The facility shall be kept vermin proof. Insect electrocution devices shall retain the insect within the device and shall not be located over food or utensil handling areas. Conditions Observed: Observed oysters in the walkin lacked stock tag, which was filed with other stock tags. Owner to return tag to oysters - COS. Keep tag with oysters until bags are empty and then file. Keep tags in chronological order and record the dates of use. Never accept shellfish without a stock tag.

17. Compliance with shell stock tags, condition, display.
Conditions Observed: Facility has receipts for oysters purchased from North Bay Shellfish on 4/18/19, 3/22/19, 5/16/19, and 5/30/19. Oysters purchased by facility must have a shellstock tag attached to the container. The tag shall include the following information: the source of the shellstock: 1. The harvester’s name and address 2. The harvester’s certification number 3. The date of harvesting 4. harvest location 5. type and quantity of shellfish 6. statement that tag is remain attached until empty or retagged and thereafter kept on file for 90 days 7. original shipper’s certification number (if applicable) Observed stock tags available for review are not organized. Keep all stock tags for 90 days using an approved record keeping system that keeps the tags in chronological order related to the dates the shellstock are served. This violation requires a reinspection on/after June 18, 2019.

Conditions Observed: Observed scallops thawing in a container of water. Inspector explained approved thawing methods. Operator turned on faucet to allow water to flow over scallops and down the drain - COS. Always thaw foods using an approved method.
ROACHY SAYS:
“Frozen foods shall be stored or displayed in their frozen state unless being thawed in the following manner: under refrigeration that maintains the food temperature at 41F or below, completely submerged under potable running water for a period not to exceed two hours at a water temperature of 70F or below and with sufficient water velocity to agitate and flush off loose particles into the sink drain, in a microwave oven if immediately followed by immediate preparation, or as part of a cooking process. 34. Non-food-contact surfaces clean.
Conditions Observed: Observed excessive food debris (e.g., a sprouting potato), build-up behind the freezer in the storage area. Remove debris; clean.

“An accurate easily readable metal probe thermometer suitable for measuring temperature of food shall be available to the food handler. Thermometers shall be calibrated in accordance with manufacturer's specifications as necessary to ensure their accuracy. Conditions Observed: Observed excessive build-up of grease on ansel system line above clean plates. Inspect plates/utensils for contamination. Remove build-up from line. Clean routinely to avoid build-up. Observed excessive build-up of grease in recessed catch at grill. Clean and sanitize impacted surfaces. Observed crates of utensils and similar items below counter. As discussed during the inspection, declutter this area. Discard items that are unnecessary for facility operations and/or are damaged. Facility lacks a designated food prep sink. Install a food prep sink with an indirect connection. Food prep sinks must be 18 by 18 by 16 inches and have an integral drainboard (or be located next to a similar surface).

Conditions Observed: FRP on the wall to lower right of the 3-part sink has failed. Replace with a finish that is smooth, durable, and non-absorbent. Dishroom and adjacent sink/food prep area lack coving. Observed excessive debris at corners below 3part. Replace flooring and install coving in the dishroom, sink/food prep area, as well as all food prep areas that complies with CalCode requirements. See notes below. This violation is to be corrected via the scope of your plan check.

“Food facilities shall be fully enclosed in a building consisting of permanent floors, walls, and an overhead structure that meets minimum standards. The walls and ceiling shall be smooth, durable, nonabsorbent, and easily cleanable.
