09. Time as public health control; procedures and records.

Conditions Observed: Observed time labels for tarter sauce and big mac sauce read “use by 7:30 AM 11/29/21”. Inspection began at 11 AM. Reviewed Time as Public Health Control with staff and PIC. Sauces were discarded. COS. Be sure that foods held at ambient temperature have the correct time label. Foods held using Time as Public Health Control must be discarded at the time noted on the label.

ROACHY SAYS:

“When time as a public health control is used, the following procedures shall be observed: food items shall be marked to indicate four hours past the time when the food was removed from temperature control, food shall be served or discarded within the four hour time limit. Written procedures shall be maintained in the food facility and made available to the enforcement agency upon request, that ensure compliance with this section and section 114002, for food that is prepared, cooked, and refrigerated before time is used as a public health control. Time only may not be used in Licensed health care facilities, public school cafeterias, or private school cafeterias. (114000)”

15. Food contact surfaces: clean and sanitized.

Conditions Observed: Observed pink slime-like build-up on the front of the divider in the ice machine. Observed an excessive amount of build-up in and on the blended ice machine. Remove build-up; throughly clean surface with hot soapy water. Rinse with clear water before sanitizing. This violation requires proof of correction prior to 4PM on 12/2/21 to avoid a reinspection.

ROACHY SAYS:

“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 34. Non-food-contact surfaces clean.

Conditions Observed: Observed pooled liquid by syrups in the bottom of the fro-yo machine. Clean; maintain a tidy fro-yo machine.

41. Plumbing: proper backflow devices.

Conditions Observed: Observed an excessive amount of water in front of the 3-part sink today. Per PIC, there is a leak from the seam at the pipe below the left bin. Observed continued use of a bucket to control for a leak at the dishwasher. Repair sink and dishwasher to eliminate free moisture.

“Steam tables, ice machines, ice bins, food preparation sinks, display cases, walk-in refrigeration units, and other similar equipment that discharge liquid waste shall drain into a floor sink with an air gap or other approved type of receptor. All plumbing and plumbing fixtures shall be installed in compliance with applicable local plumbing ordinances, maintained so as to prevent any contamination, kept clean, fully operative, and in good repair. The potable water supply shall be protected with a backflow or back siphonage protection device. Any hose used for potable water shall be of approved materials, labeled, properly stored, and used for no other purpose. Routine Inspection
08. Proper hot and cold holding temperatures.

Conditions Observed: Measured egg patties in the hot hold to be below 135 F (egg patty, 129 F; egg patty 134 f). Egg patties were discarded - COS. As observed during the inspection, it appears egg patties on the edge of the tray come out of temperature. Revise procedure to hot-hold all egg patties at 135 F or greater.

ROACHY SAYS:

“Except during preparation, cooking, cooling, transportation to or from a retail food facility for a period of less than thirty minutes, when time is used as the public health control, or as otherwise specified, potentially hazardous foods shall be maintained at or below 41F or at or above 135F. The following foods may be held at or below 45F: raw shell eggs, unshucked live molluscan shellfish, pasteurized milk and pasteurized milk products in original sealed containers, potentially hazardous foods held during transportation. Potentially hazardous foods held for dispensing in serving lines and salad bars may be held at 45F, not to exceed 12 hours in a 24 hour period, if unused portions are discarded. Conditions Observed: No time marking for lettuce, onions, and sliced cheese today (PHF held using time as temperature control). Reviewed Time as Public Health Control requirements with PIC. Stickers were printed and applied to each food container - COS. Thank you. Continue to time mark foods per CalCode requirements.

37. Equipment, utensils and linens: storage and use.

Conditions Observed: Observed two crates with sleeves of cups and lids on the floor below the front counter. Store clean utensils (this includes to-go cups) at least 6 inches above the floor.

“Clean equipment, utensils, linens, and single-use articles shall be stored at least six inches above the floor in an approved location within the fully enclosed permitted food facility. Clean equipment, utensils, linens, and single-use articles shall not be exposed to splash, dust, vermin, or other forms of contamination. Non-food items shall be stored and displayed separate from food and food-contact surfaces. During pauses in food preparation utensils shall be stored with handles above the top of the food, on a clean sanitized surface, in running water, or in water that is at least 135øF. Single-use articles and multiservice utensils shall be handled, displayed, and dispensed so that contamination of food and lip-contact surfaces is prevented. Conditions Observed: Observed the use of buckets to control for leaks today (one at the oil-water separator at the 3-part sink, one in ceiling near the CO2). Identify cause of leaks and correct. Eliminate free moisture.

Conditions Observed: Measured hot water at the handwashing sink adjacent to the office to be 124 - this is too hot. Adjust to deliver warm water at 100 to 108 F.

Hot water shall be supplied at a minimum temperature of 120F when measured from the faucet. The temperature of water provided to handwashing facilities shall be at least 100F. Conditions Observed: Observed cracking in the finish on corner of the pony wall next to the milk fridge. Repair or refurbish finish to be smooth, durable, and free of harborage. Received proof of correction via text after the inspection.

Conditions Observed: Initially measured O PPM chlorine in sani-buckets. Per Owner, the sanitizer is not activated by hot water. Buckets were emptied and refilled using cool water. Measured chlorine to be 100 PPM. COS. Train all staff to use cool water when filling sani-buckets.

ROACHY SAYS:

“Wiping cloths used to clean food spills shall be used only once or stored in a sanitizing solution of an approved concentration as specified in section 114099.6. Dry or wet cloths that are used with raw foods of animal origin shall be kept separate from cloths used for other purposes, cloths that come into contact with raw foods of animal origin shall be kept in a separate sanitizing solution. Wiping cloths shall be free of food debris and visible soil. Working containers of sanitizing solutions for storage of in-use wiping cloths shall be used in a manner to prevent contamination of food, equipment, utensils, linens, or single-use articles. Observed impacted surfaces to be clean and free of debris at the end of the inspection. MOD provided specification sheet for Frappe machine. If you have a variance, please provide a copy to our office. DEH may contact you with additional questions. Observed build-up on mount for ice scoop. Remove build-up; clean and sanitize. This violation requires a reinspection on/after February 4, 2020.

Conditions Observed: Observed one employee lacked sufficient hair restraints today (i.e., low bun with several loose strands). Keep all hair appropiately restrained for food service (e.g., tight bun with no loose strands).

ROACHY SAYS:

“Food employees shall wear clean outer clothing to prevent contamination of food, equipment, utensils, linens, and single-use articles. All food employees preparing, serving, or handling food or utensils shall wear hair restraints such as hats, hair coverings, or nets which are designed and worn to effectively keep their hair from contacting non-prepackaged food, clean equipment, utensils, linens, and unwrapped single-use articles. Conditions Observed: Observed excessive, old accumulation of grease on sides of grill, on and on cookline shell. Showed observations to PIC. Grill and ventilation system shall be professionally serviced and maintained to eliminate grease and potential safety hazards. Observed teflon used to cook eggs to be degraded. Discard; use cooking materials are in good condition (i.e., surface is smooth and free of deterioration). Observed syrup accumulation beneath bulk soda dispenser and on bottom shelf. Please maintain clean.

36. Equipment / Utensils approved; installed, clean, good repair, capacity.

Conditions Observed: Observed door on Bev-Air (unit in which temperature violations occurred) not properly closing. Repair or replace.

ROACHY SAYS:

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Equipment that is not movable must be installed to allow for cleaning in place. Cutting or piercing parts of can openers must be readily removable. Conditions Observed: Observed two crate of cups stored directly on the floor. Observed boxes of food wrappers, containers stored directly on the floor in basement. Carefully inspect box, containers for contamination and move to a location 6 inches above the floor. Store all food containers (i.e,, cups, boats, shells) six inches above the floor.

Conditions Observed: Observed build-up on filters. Have filters and ventilation system professionally cleaned by a certified cleaner.

“Approved exhaust hoods shall be provided to remove toxic gases, heat, grease, vapors and smoke. Canopy-type hoods shall extend six inches beyond all cooking equipment. Toilet rooms shall be consistent with local building codes and vented to the outside air by a screened openable window, air shaft, or light-switch activated exhaust fan. Adequate lighting shall be provided in all areas to facilitate cleaning and inspection. Light fixtures in areas where open food is stored, served, prepared, and where utensils are washed shall be of shatterproof construction or protected with light shields. Conditions Observed: Observed trash, debris, water, soda concentrate accumulating on floor in basement. Clean. Remove debris. Identify and correct leak near filter and soda concentrates. Organize items to maximize visual monitoring for vermin activity. This violation requires a reinspection on/after February 4, 2020. Observed grout has failed between tiles at and near the front handwashing sink. Maintain floors to be smooth, durable, and non-absorbent.

Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 34. Non-food-contact surfaces clean.

Conditions Observed: Observed excessive build on and around the shake machine, on and around syrup dispensers at fro-yo machine, on the wall to the right of the ice machine, on the wall to the right of the shake machine, on floors around soda stacks in the basement. Observed bag of soda concentrate on the floor (GM removed and discarded). Clean daily/routinely to avoid build-up.

37. Equipment, utensils and linens: storage and use.

Conditions Observed: Observed two boxes of food wraps on the floor. Keep utensils and food storage items at least 6 inches above the ground.

Clean equipment, utensils, linens, and single-use articles shall not be exposed to splash, dust, vermin, or other forms of contamination. During pauses in food preparation utensils shall be stored with handles above the top of the food, on a clean sanitized surface, in running water, or in water that is at least 135øF. 40. Wiping cloths: properly used and stored.

Conditions Observed: No chlorine in the sani-bucket at the dishwasher today. Keep cloths in a solution of 100 PPM chlorine.

ROACHY SAYS:

“Wiping cloths used to clean food spills shall be used only once or stored in a sanitizing solution of an approved concentration as specified in section 114099.6. Dry or wet cloths that are used with raw foods of animal origin shall be kept separate from cloths used for other purposes, cloths that come into contact with raw foods of animal origin shall be kept in a separate sanitizing solution. Wiping cloths shall be free of food debris and visible soil. Working containers of sanitizing solutions for storage of in-use wiping cloths shall be used in a manner to prevent contamination of food, equipment, utensils, linens, or single-use articles. 41. Plumbing: proper backflow devices.

Conditions Observed: Observed streaking/staining on basement ceiling and nearby pipes. Per GM, the pipe serving the floor sink is leaking. Repair to eliminate leak.

ROACHY SAYS:

“Steam tables, ice machines, ice bins, food preparation sinks, display cases, walk-in refrigeration units, and other similar equipment that discharge liquid waste shall drain into a floor sink with an air gap or other approved type of receptor. All plumbing and plumbing fixtures shall be installed in compliance with applicable local plumbing ordinances, maintained so as to prevent any contamination, kept clean, fully operative, and in good repair. The potable water supply shall be protected with a backflow or back siphonage protection device. Any hose used for potable water shall be of approved materials, labeled, properly stored, and used for no other purpose. 39. Thermometers provided and accurate.

Conditions Observed: Unable to locate a thermometer in the bev-air fridge at the drive-thru. Provide a thermometer for this fride.

ROACHY SAYS:

“An accurate easily readable metal probe thermometer suitable for measuring temperature of food shall be available to the food handler. Thermometers shall be calibrated in accordance with manufacturer's specifications as necessary to ensure their accuracy. A thermometer +/- 2 degrees F shall be provided for all refrigerators, hot and cold holding units, and high temperature warewashing machines. (114157, 114159)”

Routine Inspection
06. Hands clean and properly washed; gloves used properly.

Conditions Observed: Observed employee don white gloves and begin prepping to assemble burritos; did not observe handwashing, Inspector informed manager and employee that hands shall be washed prior to donning gloves. Observed correct handwashing by employee - COS. Observed employee use blue glove to sprinkle seasoning on cooked burger. Use blue gloves for their intended purpose. Use a utensil to add spices to burgers. Obtain the correct utensil immediately. Retrain all staff in correct glove use and preventing cross contamination.

ROACHY SAYS:

“Food employees shall minimize bare hand and arm contact with nonprepackaged food that is in ready to eat form. Whenever gloves are worn, they shall be changed, replaced, or washed as often as handwashing is required. Single-use gloves shall not be washed. 08. Proper hot and cold holding temperatures.

Conditions Observed: Measured a temperature gradient in the chicken nugget hot hold (nugget, 133 F; 130 F). It appears the hot hold is cooler of on the line side. Showed observations to manager. Adjust, service, repair to hot hold all nuggests at 135 F or greater. Measured hash browns hot holding above the fry bins to be 123 F. Operator discarded hash browns. COS. Revise method to hot hold at 135 F or greater or cook this item to order. Manager indicated they will cook this item to order.

ROACHY SAYS:

“Except during preparation, cooking, cooling, transportation to or from a retail food facility for a period of less than thirty minutes, when time is used as the public health control, or as otherwise specified, potentially hazardous foods shall be maintained at or below 41F or at or above 135F. The following foods may be held at or below 45F: raw shell eggs, unshucked live molluscan shellfish, pasteurized milk and pasteurized milk products in original sealed containers, potentially hazardous foods held during transportation. Potentially hazardous foods held for dispensing in serving lines and salad bars may be held at 45F, not to exceed 12 hours in a 24 hour period, if unused portions are discarded. Food preparation shall not exceed two cumulative hours without a return to the required holding temperatures. (113996, 113998, 114037, 114343(a))”

09. Time as public health control; procedures and records.

Conditions Observed: Observed Time as Public Health foods (lettuce, cheese, pickles) lacked the sticker that indicates when 4 hours have elapsed. All Time as Public Health foods shall be marked upon removal from temperature control. Employees labeled each item - COS. Please train employees responsible for this task in Time as Public Health Contol.

ROACHY SAYS:

“When time as a public health control is used, the following procedures shall be observed: food items shall be marked to indicate four hours past the time when the food was removed from temperature control, food shall be served or discarded within the four hour time limit. Written procedures shall be maintained in the food facility and made available to the enforcement agency upon request, that ensure compliance with this section and section 114002, for food that is prepared, cooked, and refrigerated before time is used as a public health control. Time only may not be used in Licensed health care facilities, public school cafeterias, or private school cafeterias. (114000)”

Conditions Observed: Observed excessive build-up on the following pieces of equipment: 1. On the bottom and around the fro-yo dispenser (showed observation to manager) 2. On the wire shelving above the fry bins 3. On the edges of the hot hold at the end of the line 4. In the cabinet containing soda syrups 5. On the area above the mixer for blended beverages 6. Around the cream dispenser 7. On the bottom of the 2-door prep fridge (showed observations to manager) Remove build-up. Clean and sanitize. Increase cleaning frequency to avoid build-up.
