07. Adequate handwash facilities supplied and accessible.

Conditions Observed: Observed immersion blender in handwash sink basin. Maintain handwash sinks clean and unobstructed at all times for handwashing. Operator moved immersion blender to the 3 compartment sink, this minor violation was corrected. Observed employee drain lettuce in handwash sink. Food preparation shall be conducted at the dedicated food preparation sink; handwashing shall be conducted at the dedicated handwashing sink. Train all staff on the dedicated use of each sink.

ROACHY SAYS:

“Handwashing facilities shall be provided within or adjacent to toilet rooms, food preparation, and warewashing areas. Handwashing facilities shall be clean, unobstructed, and accessible at all times. Handwashing facilities shall be provided with soap and sanitary single use towels in approved dispensers. 08. Proper hot and cold holding temperatures.

Conditions Observed: Measured eggs and butter 76F, held out of temperature control on the cookline. You may hold potentially hazardous foods (PHF) out of temperature control if they are time labeled for 4 hours and then discarded after that 4 hours has past, otherwise hold cold PHF at or below 41F at all times. Operator voluntarily discarded eggs and butter, this major violation was corrected. Measured shredded cheese 43F and sour cream 46F in top portion of the prep table. Measured steak 48F, shredded cheese 45F and ambient air 46F in bottom portion of the prep table. Adjust/service/repair prep table to hold cold PHF at or below 41F at all times.

ROACHY SAYS:

“Except during preparation, cooking, cooling, transportation to or from a retail food facility for a period of less than thirty minutes, when time is used as the public health control, or as otherwise specified, potentially hazardous foods shall be maintained at or below 41F or at or above 135F. The following foods may be held at or below 45F: raw shell eggs, unshucked live molluscan shellfish, pasteurized milk and pasteurized milk products in original sealed containers, potentially hazardous foods held during transportation. Potentially hazardous foods held for dispensing in serving lines and salad bars may be held at 45F, not to exceed 12 hours in a 24 hour period, if unused portions are discarded. Conditions Observed: Observed raw chicken stored over cooked chicken in bottom portion of the prep table. Observed raw eggs stored over coconuts in walk-in refrigerator. Store raw PHF away from ready-to-eat foods, based on final internal cooking temperatures to prevent cross-contamination.

Conditions Observed: Observed 2 bowls fully submerged in maseca bulk food container. Observed utensil handle in direct contact with dried beans in bulk food container. Obtain approved utensils with handles, and store with handles facing up out of contact with food to prevent cross-contamination. Observed tortillas stored in direct contact with an unused garbage bag. Obtain commercial (NSF) food-grade containers for food storage.

Conditions Observed: Observed buildup starting to form inside of ice machine. Follow manufacturer’s instructions to clean and sanitize the ice machine to prevent buildup or mold growth.

38. Adequate ventilation and lighting, designated areas, use.

Conditions Observed: Observed grease accumulation on ventilation hood, fire suppression system and light fixtures. Observed single-use glove used in place of a grease catcher. The ventilation hood must be maintained in accordance with the Uniform Mechanical Code and maintained by a professional cleaning service routinely to increase air flow and prevent a fire hazard.

ROACHY SAYS:

“Approved exhaust hoods shall be provided to remove toxic gases, heat, grease, vapors and smoke. Canopy-type hoods shall extend six inches beyond all cooking equipment. Toilet rooms shall be consistent with local building codes and vented to the outside air by a screened openable window, air shaft, or light-switch activated exhaust fan. Adequate lighting shall be provided in all areas to facilitate cleaning and inspection. Light fixtures in areas where open food is stored, served, prepared, and where utensils are washed shall be of shatterproof construction or protected with light shields. Conditions Observed: Observed open dumpsters in trash area and debris on the ground. Keep dumpsters closed and maintain garbage facilities clean.

“The exterior premises of a food facility shall be kept free of litter and rubbish. All food waste and rubbish shall be kept in nonabsorbent, durable, cleanable, leak-proof, and rodent-proof containers. Containers shall have close-fitting lids and be covered at all times. All waste must be removed and disposed of as frequently as necessary to prevent the development of objectionable odors and other conditions that attract or harbor insects or rodents. 44. Premises; personal/cleaning items; vermin-proofing.

Conditions Observed: Observed torn screen above pipe in loading dock area. Repair/replace screen with at least 16 mesh per square inch screening to prevent entrance or harborage of animals, birds and vermin, including but not limited to, insects and rodents. Provide proof of this correction by 1/6/20 to avoid a billable reinspection.

Billable Reinspection
44. Premises; personal/cleaning items; vermin-proofing.

Conditions Observed: Facility has wall penetrations for pipes that allow vermin ingress into and through facility. Facility lacks door thresholds in rear of building leaving gaps capable of admitting rodents. Vermin proof facility (door sweeps, roof vents, etc.). Repairs must be complete and a billable reinspection will be conducted on or after 12/16/19.

Billable Reinspection CLOSED
10. Proper cooling methods.

Conditions Observed: Improper cooling was observed during the routine inspection conducted on 11/7/19. The facility was required to submit cooling logs and written procedures for cooling of all foods. A procedure was not developed and foods were observed today in the process of being cooled and beans measured at 78F. The cook was unsure as to how long it had been in the 135-70F temperature range. The chicken dish in the walkin that had been cooled the previous afternoon was measured at 42.5F. The other foods in the walkin were measured at 39.5F demonstrating that the chicken dish had failed to cool properly. Facility was required to develop an effective cooling procedure for cook/cool foods, log all cooling accurately, and monitor these processes but failed to do so. Improper cooling is one of the risk factors for food borne illness. Facility must develop an adequate cooling procedure for each cook/cool food item, monitor and log these temperatures, and adhere to the procedure.

ROACHY SAYS:

“After heating, potentially hazardous foods shall be rapidly cooled from 135F to 70F within 2 hours, and then from 70F to 41F within 4 hours. Potentially hazardous foods prepared from ambient temperature ingredients must be cooled to below 41F within 4 hours. Cooling shall be facilitated by one or more of the following methods: in shallow pans, separating food into smaller portions, adding ice as an ingredient, using an ice bath and stirring frequently, using an ice paddle, using rapid cooling equipment, or using containers that facilitate heat transfer. 15. Food contact surfaces: clean and sanitized.

Conditions Observed: The dishwasher was scheduled to be repaired on 11/15/19 and the service invoice was to be submitted to this office in place of a billable reinspection. An invoice was not submitted to this office as required, and dishwasher is still not capable of providing chlorine sanitizer at the required concentration of 50PPM.

ROACHY SAYS:

“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 52. Permit Suspension - Facility Closed

Conditions Observed: Based on persistent improper cooling this facility has been closed and the permit suspended by Humboldt County Division of Environmental Health (DEH). At any time within 15 days after this issuance, the permit holder may request in writing a hearing before a hearing officer to show cause why this permit suspension is not warranted. The hearing shall be held within 15 days of receipt of the written request for a hearing. The facility may not reopen or prepare food until the permit is reinstated by DEH. Requirements to reopen: -Develop cooling procedure for all cook/cool foods and train staff in its use. Procedure should include the proper use of cooling logs. -Obtain properly working probe thermometers in sufficient number for kitchen staff to use. -Schedule an appointment with our office to discuss corrections made prior to requesting a reopening inspection. -Repair automatic sanitizing dish machine so that it functions properly. This means that the automatic sanitizer dispenser should function to dispense the chlorine bleach as it was designed to. The function and sanitizer level of the machine should be tested and logged at least once daily.

ROACHY SAYS:

“A permit may be suspended or revoked by a local enforcement officer for a violation of this part. Any food facility for which the permit has been suspended shall close and remain closed until the permit has been reinstated. Any food facility for which the permit has been revoked shall close and remain closed until a new permit has been issued. If any imminent health hazard is found, unless the hazard is immediately corrected, an enforcement officer may temporarily suspend the permit and order the food facility immediately closed. Conditions Observed: Mechanical dishwasher is scheduled to be repaired today. Submit service invoice to this office by 11/18/19 showing that the mechanical dishwasher has been repaired and is capable of providing chlorine sanitizer solution at 50PPM to avoid a billable reinspection.

Conditions Observed: Observed debris on ground surrounding dumpsters. Dumpsters should be stored on the concrete slab so that you can maintain the surface underneath clean and free of debris.

All food waste and rubbish shall be kept in nonabsorbent, durable, cleanable, leak-proof, and rodent-proof containers. Containers shall have close-fitting lids and be covered at all times. 44. Premises; personal/cleaning items; vermin-proofing.

Conditions Observed: Facility has wall penetrations for pipes that allow vermin ingress into and through facility. Facility lacks door thresholds in rear of building leaving gaps capable of admitting rodents. Contact professional pest control service to vermin proof facility (door sweeps, roof vents, etc.). Repairs must be complete and a reinspection will be conducted in approximately 30 days. *Note that snap traps are not permitted in a food facility and must be removed.

Conditions Observed: Dishwasher is still nonfunctional and is scheduled to be repaired on Friday, 11/15/19. Submit service invoice to this office showing that the dishwasher is able to provide chlorine sanitizer at 50PPM to this office in place of a billable reinspection.

ROACHY SAYS:

“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Conditions Observed: Provide chlorine test strips, store in a readily available location and use daily to verify dishwasher is providing chlorine sanitizer at 50PPM and sanitizer buckets are 100PPM.

Conditions Observed: Observed nonfunctional prep table on cookline. Repair/replace prep table cookline to hold cold potentially hazardous foods at or below 41F. Ice baths are temporary, you must have mechanical refrigeration.

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Conditions Observed: Install thermometers in a readily visible and warmest location of all refrigeration units to monitor cold holding temperatures regularly. Provide more stem thermometers on the cookline to verify cooling, reheating and cooking temperatures.

“An accurate easily readable metal probe thermometer suitable for measuring temperature of food shall be available to the food handler. Thermometers shall be calibrated in accordance with manufacturer's specifications as necessary to ensure their accuracy. Submit spec sheets or floor samples to this office for approval prior to purchase and installation. Observed peeling paint on walls in warewash area. Conditions Observed: Measured beverage mixers, juice and fruit (strawberries and peaches) stored in nonfunctional BevAir 2 door refrigerator at 56F with probe thermometer. Potentially hazardous foods shall be maintained at or below 41F at all times. All potentially hazardous foods stored in nonfunctional refrigerator were discarded. Measured potatoes 42F and shredded cabbage 49F with probe thermometer held in an ice bath in nonfunctional prep table on cookline. Repair/replace nonfunctional prep table to hold cold potentially hazardous foods at or below 41F at all times.

ROACHY SAYS:

“Except during preparation, cooking, cooling, transportation to or from a retail food facility for a period of less than thirty minutes, when time is used as the public health control, or as otherwise specified, potentially hazardous foods shall be maintained at or below 41F or at or above 135F. The following foods may be held at or below 45F: raw shell eggs, unshucked live molluscan shellfish, pasteurized milk and pasteurized milk products in original sealed containers, potentially hazardous foods held during transportation. Potentially hazardous foods held for dispensing in serving lines and salad bars may be held at 45F, not to exceed 12 hours in a 24 hour period, if unused portions are discarded. Food preparation shall not exceed two cumulative hours without a return to the required holding temperatures. (113996, 113998, 114037, 114343(a))”

10. Proper cooling methods.

Conditions Observed: Measured chicken 48F & 46.5F; beef 51F & 50F with probe thermometer, cooling in walk-in refrigerator since yesterday (11/6/19). Potentially hazardous foods must be rapidly cooled from 135F - 70F or below within 2 hours and from 70F - 41F or below within another 4 hours (6 hours total). All improperly cooled foods in the walk-in refrigerator were discarded. Improper cooling of potentially hazardous foods is identified as a major risk factor associated with foodborne illness and must be corrected going forward. This is a major violation that will require a reinspection on or after 11/12/19. See Overall Inspection Comments for requirements to maintain permit.

ROACHY SAYS:

“After heating, potentially hazardous foods shall be rapidly cooled from 135F to 70F within 2 hours, and then from 70F to 41F within 4 hours. Potentially hazardous foods prepared from ambient temperature ingredients must be cooled to below 41F within 4 hours. Cooling shall be facilitated by one or more of the following methods: in shallow pans, separating food into smaller portions, adding ice as an ingredient, using an ice bath and stirring frequently, using an ice paddle, using rapid cooling equipment, or using containers that facilitate heat transfer. 12. Proper reheating procedures for hot holding.

Conditions Observed: Measured chili verde 132.5F with probe thermometer in the steam table. Potentially hazardous foods must be reheated to at least 165F prior to hot holding in the steam table. Instructed cook to reheat chili verde to at least 165F on the stove. This major violation was corrected, thank you.

ROACHY SAYS:

“Potentinally hazardous food that is cooked, cooled, and reheated for hot holding shall be heated to a temperature of 165F for 15 seconds. Cooked and refrigerated food that is prepared for immediate service in response to an individual consumer order may be served at any temperature. Reheating for hot holding shall be done rapidly, and the time between 41F and 165F shall not exceed two hours. Potentinally hazardous food reheated in a microwave oven for hot holding shall be rotated or stirred midway during cooking, covered to retain surface moisture, be reheated to 165F in all parts of the food, and stand covered for at least two minutes after reheating. Ready-to-eat food taken from a commercailly processed hermetically sealed container or from an intact package from a food processing plant shall be heated to a temperature of 135F for hot holding. Conditions Observed: Measured chlorine sanitizer 0PPM in server station sanitizer bucket. Measured chlorine sanitizer 0PPM in dishwasher. Use chlorine test strips to verify the correct concentration of chlorine sanitizer in sanitizer buckets and dishwasher to ensure you are correctly sanitizing food contact surfaces. The facility was put on a compliance schedule to install a functional dishwasher. A dishwasher was installed without detergent and is not currently dispensing chlorine sanitizer. Conditions Observed: Hot water is not provided at handwash sinks in women’s and men’s restrooms. Hot water is required for handwashing. Provide hot water to both restroom handwashing sinks immediately. This is a major violation that will require a reinspection on or after 11/12/19.

ROACHY SAYS:

“An adequate, protected, pressurized, approved potable supply of hot and cold water shall be provided at all times. Hot water shall be supplied at a minimum temperature of 120F when measured from the faucet. The temperature of water provided to handwashing facilities shall be at least 100F. Handwashing facilities equipped with non-adjustable faucets shall have their temperature set between 100F and 108F. Hot water shall be provided at the food preparation sink and janitorial sink. 24. No rodents, insects, birds, or animals.

Conditions Observed: Observed old evidence of rodent activity in back dry storage room. Observed rodent track marks, suspect urine stains and dried feces on back stock of 2 canned food items and on unused bulk food container lids. All contaminated foods and food containers were discarded. Engage professional pest control service and keep invoices on file for review. All exposed foods in the facility must be kept in rigid containers with tight fitting lids to prevent contamination. All surfaces in dry storage room must be washed and sanitized. Conditions Observed: Observed raw potentially hazardous foods stored over ready-to-eat foods in walk-in refrigerator. Store raw potentially hazardous foods under ready-to-eat foods based on final internal cooking temperatures to prevent cross-contamination. Observed uncovered foods stored in all refrigeration units. Cover all stored foods to prevent contamination. Observed open bulk bags of food lacking containers with lids. Transfer all bulk foods to containers with lids to prevent contamination and vermin attraction.

ROACHY SAYS:

“Food shall be protected from contamination during transportation, storage, preparation, holding, and display. Adequate and suitable counter space shall be provided for all food preparation. Food preparation shall be conducted wthin an approved food compartment or fully enclosed food facility. Open-air barbecues shall be separated from public access. 31. Food storage; food storage containers identified.

Conditions Observed: Observed food stored on the floor in walk-in freezer. Store all foods at least 6 inches above the floor to prevent contamination or potential vermin attraction. Observed prepared foods stored in refrigeration units lacking labels. Label all foods.

ROACHY SAYS:

“Adequate and suitable space shall be provided for the storage of food. Food shall be protected from contamination by storing the food in a clean, dry location, where it is not exposed to splash, dust, vermin, or other forms of contamination or adulteration, and at least six inches above the floor. Food shall not be stored in any of the following ways: in locker rooms, toilet rooms, dressing rooms, refuse rooms, mechanical rooms, under sewer lines that are not shielded to intercept potential drips, under leaking water lines, including leaking automatic fire sprinklers heads, or under lines on which water has condensated, under open stairwells or under sources of contamination. Working containers holding food or food ingredients that are removed from their original packages for use in the food facility shall be identified with the common name of the food. Non-prepackaged food may not be stored in direct contact with undrained ice. Conditions Observed: Observed plastic single-use container used to potion bulk beans. Obtain an approved utensil with a handle, that is smooth, durable, nonabsorbent and easy to clean. Observed mold-like substance and debris in floor sink adjacent to soda machine. Maintain floor sinks clean and free of debris. Observed electrical extension cords throughout the facility. Install approved, permanent electrical fixtures.

ROACHY SAYS:

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Equipment that is not movable must be installed to allow for cleaning in place. Cutting or piercing parts of can openers must be readily removable. 38. Adequate ventilation and lighting, designated areas, use.

Conditions Observed: Walk-in freezer is lacking a light. Repair/replace to provide adequate lighting. Observed grease accumulation on ventilation hood, fire suppression system and light fixtures. Observed single-use glove used in place of a grease catcher. The ventilation hood must be maintained in accordance with the Uniform Mechanical Code and shall be cleaned by a professional routinely to increase air flow and prevent a fire hazard.

ROACHY SAYS:

“Approved exhaust hoods shall be provided to remove toxic gases, heat, grease, vapors and smoke. Canopy-type hoods shall extend six inches beyond all cooking equipment. Toilet rooms shall be consistent with local building codes and vented to the outside air by a screened openable window, air shaft, or light-switch activated exhaust fan. Adequate lighting shall be provided in all areas to facilitate cleaning and inspection. Light fixtures in areas where open food is stored, served, prepared, and where utensils are washed shall be of shatterproof construction or protected with light shields. 41. Plumbing: proper backflow devices.

Conditions Observed: Observed several waste pipes in the dish room that are spilling onto the floor instead of draining into the floor sink, as required. Repair to prevent wastewater from draining onto the floor.

ROACHY SAYS:

“Steam tables, ice machines, ice bins, food preparation sinks, display cases, walk-in refrigeration units, and other similar equipment that discharge liquid waste shall drain into a floor sink with an air gap or other approved type of receptor. All plumbing and plumbing fixtures shall be installed in compliance with applicable local plumbing ordinances, maintained so as to prevent any contamination, kept clean, fully operative, and in good repair. The potable water supply shall be protected with a backflow or back siphonage protection device. Any hose used for potable water shall be of approved materials, labeled, properly stored, and used for no other purpose. 42. Garbage and refuse properly disposed; facilities maintained.

Conditions Observed: Observed garbage facilities are not being maintained. Lock dumpsters and maintain garbage facilities clean and free of debris.

All food waste and rubbish shall be kept in nonabsorbent, durable, cleanable, leak-proof, and rodent-proof containers. Containers shall have close-fitting lids and be covered at all times. All waste must be removed and disposed of as frequently as necessary to prevent the development of objectionable odors and other conditions that attract or harbor insects or rodents. 44. Premises; personal/cleaning items; vermin-proofing.

Conditions Observed: Facility has wall penetrations for pipes that allow vermin ingress into and through facility. Facility lacks door thresholds in rear of building leaving gaps capable of admitting rodents. Nonfunctional equipment is stored inside and outside of facility (ice machine, steam table, prep table. dishwasher, etc.). Remove all nonfunctional equipment from the facility.

ROACHY SAYS:

“All premises of a food facility shall be kept clean, fully operative, and in good repair. The premise of a food facility shall be free of litter and items unnecessary to the operation of the facility. Areas designated for employees to eat and drink shall be located so that food, clean equipent and utensils, linens, and single-use articles are protected from contamination. A dedicated janitorial sink with a drain shall be provided and conveniently located. A separate room, area, or cabinet shall be provided for cleaning supplies. The facility shall be kept vermin proof. Insect electrocution devices shall retain the insect within the device and shall not be located over food or utensil handling areas. 45. Floor, walls, and ceilings: built, maintained, clean.

Conditions Observed: Observed floors and coving are failing throughout the facility. Repair/replace to provide a smooth surface that is durable, nonabsorbent and easy to clean with 3/8” radius coving that extends at least 4 inches up the wall. Submit spec sheets or floor samples to this office for approval prior to purchase and installation. Observed peeling paint on walls in warewash area. Repair/replace with gloss or semi-gloss paint, epoxy paint, FRP, stainless steel, ceramic tile or other approved material/finishes.

24. No rodents, insects, birds, or animals.

Conditions Observed: Observed rodent feces have not been removed from dry storage room. Observed uncovered open bulk bags of food in same location. Observed unapproved snap traps in this location. Follow CDC guidelines to remove the rodent feces from impacted area, clean and sanitize and store all open bags of food in rigid containers with lids. Remove debris, litter, clutter and all items unnecessary to the operation or maintenance of the facility. Strongly recommend contacting professional pest control service to start integrated pest management at the facility - keep pest control service invoice on file for review. This is a repeat violation that has resulted in a billable reinspection in the amount of $133 to be conducted on or after 5/20/19.

ROACHY SAYS:

15. Food contact surfaces: clean and sanitized.

Conditions Observed: Dishwasher sanitizer solution is empty. Chlorine bleach was not provided in the facility. See #52. Facility demonstrated manual warewashing at 3 compartment sink with chlorine sanitizer solution measuring 100PPM. Manual warewashing to continue until dishwasher is serviced by a professional. Keep service invoice on file for review during reinspection. This is a major violation that will require a reinspection on or after 5/16/19.

ROACHY SAYS:

“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. Observed large container of uncovered ice stored on a cart adjacent to the bar entrance. Cover this container of ice to prevent contamination. Observed uncovered food stored in walk-in freezer. Cover all stored foods to prevent contamination or adulteration.

“Food shall be protected from contamination during transportation, storage, preparation, holding, and display. Adequate and suitable counter space shall be provided for all food preparation. 29. Washing fruits and vegetables.

Conditions Observed: Observed employee wash shredded lettuce at visibly soiled 3 compartment sink. The 3 compartment sink shall only be used for warewashing. Designate the 2 compartment sink in the back of the facility as a prep sink for washing fruits and vegetables. The sinks shall be washed, rinsed and sanitized before and after each use to prevent cross-contamination.

ROACHY SAYS:

“Produce shall be thoroughly washed in potable water to remove soil and other contaminants before being cut, combined with other ingredients, cooked, served, or offered for human consumption. Chemicals used to wash or peel produce shall meet the requirements specifice in 21 CFR 173.315. (113992)”

30. Toxic substances properly identified, stored, used.

Conditions Observed: Observed unlabeled chemical spray bottled in use at facility. Label all chemicals when taken out of original manufacturer’s packaging for safety.

“Only those insecticides, rodenticides, and other pesticides that are necessary, bear a legible manufacturer's label, and are specifically approved for use in a food facility may be used in a food facility in accordance with the manufacturer's instructions. Containers used for storing poisonous or toxic materiails such as cleaners and sanitizers taken from bulk supplies shall be clearly and individually identified with the common name of the material. Conditions Observed: Observed standing water/beer and mold-like substance in bottom of both keg refrigerators. Observed mold-like substance in soda machine drain board. Clean non-food contact surfaces of equipment regularly.

Conditions Observed: Test strips were not available during the inspection. Obtain chlorine test strips, store near 3 compartment sink and use daily to verify the dishwasher is providing chlorine sanitizer at 50PPM and to verify the chlorine sanitizer solution in sanitizer buckets is 100PPM. Test strips were provided at the end of the inspection.

Observed deep fryer utensils stored on soiled shelving unit. Clean shelving unit adjacent to the deep fryer. Observed spoon handle in direct contact with salsa inside True 3 door refrigerator. Store utensils with handles, up out of contact with food to prevent cross-contamination.

ROACHY SAYS:

“Clean equipment, utensils, linens, and single-use articles shall be stored at least six inches above the floor in an approved location within the fully enclosed permitted food facility. Clean equipment, utensils, linens, and single-use articles shall not be exposed to splash, dust, vermin, or other forms of contamination. Non-food items shall be stored and displayed separate from food and food-contact surfaces. During pauses in food preparation utensils shall be stored with handles above the top of the food, on a clean sanitized surface, in running water, or in water that is at least 135øF. “Wiping cloths used to clean food spills shall be used only once or stored in a sanitizing solution of an approved concentration as specified in section 114099.6. Dry or wet cloths that are used with raw foods of animal origin shall be kept separate from cloths used for other purposes, cloths that come into contact with raw foods of animal origin shall be kept in a separate sanitizing solution. Wiping cloths shall be free of food debris and visible soil. Working containers of sanitizing solutions for storage of in-use wiping cloths shall be used in a manner to prevent contamination of food, equipment, utensils, linens, or single-use articles. Keep back door closed at all times, or install a screen to prevent entrance or harborage of animals, birds, or vermin, including but not limited to, insects and rodents.

52. Permit Suspension - Facility Closed

Conditions Observed: Based on the lack of ability to sanitize equipment and utensils, this facility has been closed and the permit suspended by Humboldt County Division of Environmental Health (DEH). The facility shall cease operation immediately and remain closed until a method to clean and sanitize equipment and utensils is provided. At any time within 15 days after this issuance, the permit holder may request in writing a hearing before a hearing officer to show cause why this permit suspension is not warranted. The hearing shall be held within 15 days of receipt of the written request for a hearing. The facility may not reopen or prepare food until the permit is reinstated by DEH. Manager purchased dish detergent, chlorine sanitizer solution, bleach and test strips during the inspection. The dishwasher is unable to dispense chlorine sanitizer solution and shall be serviced by a professional company. In the meantime, the facility demonstrated the 3 compartment manual warewashing method by washing, rinsing and sanitizing utensils with 100PPM chlorine sanitizer solution in the 3 compartment sink. Your permit to operate has been reinstated.

“A permit may be suspended or revoked by a local enforcement officer for a violation of this part. Any food facility for which the permit has been suspended shall close and remain closed until the permit has been reinstated. Any food facility for which the permit has been revoked shall close and remain closed until a new permit has been issued. If any imminent health hazard is found, unless the hazard is immediately corrected, an enforcement officer may temporarily suspend the permit and order the food facility immediately closed. Routine Inspection
07. Adequate handwash facilities supplied and accessible.

Conditions Observed: Observed cookline handwash sink has low water pressure, which is not sufficient for properly washing hands. Repair/replace cookline handwash to deliver hot water at an efficient water pressure to wash hands properly at all times. Send service invoice to this office for verification that sink has been repaired and is working properly.

ROACHY SAYS:

“Handwashing facilities shall be provided within or adjacent to toilet rooms, food preparation, and warewashing areas. Handwashing facilities shall be clean, unobstructed, and accessible at all times. Handwashing facilities shall be provided with soap and sanitary single use towels in approved dispensers. Dispensers shall be maintained in good repair. A handwashing facility shall not be used for purposes other than handwashing. (113953, 113953.1, 113953.2, 114067(f))”

08. Proper hot and cold holding temperatures.

Conditions Observed: Measured tofu 124.5F with probe thermometer in steam table (hot hold #1). Observed water line was low in steam table. Per cook, the tofu was in the steam table for approximately 30 minutes. Instructed cook to reheat tofu on stove to 165F and add more hot water to steam table. The tofu was reheated and transfered to the hot hold unit. Thank you. Measured chopped garlic 47.5F and chopped vegetables 43.5F with probe thermometer in Beverage Air prep table on cookline. Observed iced over condenser inside of this unit. Employees submerged all potentially hazardous foods in ice baths that measured below 41F. The ice baths are temporary until this prep table is repaired. Once repaired, submit service invoice to this office for verification that it is working properly.

ROACHY SAYS:

“Except during preparation, cooking, cooling, transportation to or from a retail food facility for a period of less than thirty minutes, when time is used as the public health control, or as otherwise specified, potentially hazardous foods shall be maintained at or below 41F or at or above 135F. The following foods may be held at or below 45F: raw shell eggs, unshucked live molluscan shellfish, pasteurized milk and pasteurized milk products in original sealed containers, potentially hazardous foods held during transportation. Potentially hazardous foods held for dispensing in serving lines and salad bars may be held at 45F, not to exceed 12 hours in a 24 hour period, if unused portions are discarded. Food preparation shall not exceed two cumulative hours without a return to the required holding temperatures. (113996, 113998, 114037, 114343(a))”

15. Food contact surfaces: clean and sanitized.

Conditions Observed: Observed cookline and food prep areas lacking sanitizer buckets for sanitizing food contact surfaces while operating. Instructed cook to obtain sanitizer solution for wiping cloths storage and for sanitizing food contact surfaces. Sanitizer buckets with chlorine sanitizer solution measuring 100ppm were provided. Ensure the containers used for sanitizer are labeled, and not used to store foods in. Thank you.

ROACHY SAYS:

“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 27. Approved thawing methods used; frozen food.

Conditions Observed: Observed fish thawing in a tub of standing water. Use an approved method (listed above) for thawing potentially hazardous foods.

ROACHY SAYS:

“Frozen foods shall be stored or displayed in their frozen state unless being thawed in the following manner: under refrigeration that maintains the food temperature at 41F or below, completely submerged under potable running water for a period not to exceed two hours at a water temperature of 70F or below and with sufficient water velocity to agitate and flush off loose particles into the sink drain, in a microwave oven if immediately followed by immediate preparation, or as part of a cooking process. (114018, 114020)”

28. Food separated and protected.

Conditions Observed: Observed uncovered food stored in refrigeration and freezer units and uncovered condiments in the bar. Cover all stored food to protect from contamination. Observed open bulk bags of food in dry storage. Once a bulk bag of food is opened, transfer it to a rigid container with a tight fitting lid to protect bulk foods from contamination. Observed dust accumulation on ceiling above cookline. Remove dust to protect foods that are handled underneath. Observed raw potentially hazardous foods (fish), stored above ready-to-eat foods (carrots) in walk-in refrigerator. Store raw potentially hazardous foods under ready-to-eat foods based on final internal cooking temperatures to protect ready-to-eat foods from cross-contamination.

ROACHY SAYS:

“Food shall be protected from contamination during transportation, storage, preparation, holding, and display. Adequate and suitable counter space shall be provided for all food preparation. Food preparation shall be conducted wthin an approved food compartment or fully enclosed food facility. Open-air barbecues shall be separated from public access. (113984(a-f), 113986, 114060, 114067(a,d,e,j), 114069(a, c, d), 114077, 114089.1(c), 114143(c,e))”

34. Non-food-contact surfaces clean.

Conditions Observed: Observed food debris on Kitchen Aid mixer. Observed mold-like substance on cutting boards used as a table top in server station. Observed standing water and mold-like substance in bottom of keg refrigerator. Clean non-food contact surfaces regularly.

ROACHY SAYS:

“Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris. (114115(b))”

35. Warewashing: installed, maintained, used, Adequate Means to measure sanitizer

Conditions Observed: Test strips were not available. Obtain chlorine test strips, keep near 3 compartment sink, and use daily to verify chlorine sanitizer is delivered at the dishwasher at 50ppm and 100ppm in sanitizer buckets.

ROACHY SAYS:

“Facilities that prepare food shall be equipped with a manual warewashing sink that has at least three compartments with two integral metal drainboards, except as specified in 114099(c). A warewashing sink shall not be used for handwashing except as specified in 114125(a). Sink compartments shall be large enough to accommodate immersion of the largest equipment and utensils used. Testing materials shall be provided to adequately measure the applicable sanitization method used during manual or mechanical warewashing. (114067(f,g), 114099, 114099.3, 114099.5, 114101(a), 114101.1, 114101.2, 114103, 114107, 114125(a))”

36. Equipment / Utensils approved; installed, clean, good repair, capacity.

Conditions Observed: Observed non-commercial microwave in use at facility. Replace with commercial microwave when current unit fails. Observed unapproved utensils being used as scoops in bulk food bins. Obtain scoops with handles that are smooth, durable, nonabsorbent and easy to clean. Observed ventilation hood is lacking a grease catcher. Observed a disposable glove is used to collect the grease. Replace grease catcher at ventilation hood. Observed various floor sinks containing food debris. Ensure you are scraping food debris from utensils prior to warewash. Clean floor sinks regularly. Observed broken fan in walk-in freezer. Repair fan.

ROACHY SAYS:

“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Equipment that is not movable must be installed to allow for cleaning in place. Cutting or piercing parts of can openers must be readily removable. Facilities that wash, rinse, soak, thaw, or similarly prepare foods shall be provided with a approved food preparation sink. Reservoirs that supply water to produce foggers must be cleaned and maintained. Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced or replaced if they can no longer be effectively cleaned and sanitized. 37. Equipment, utensils and linens: storage and use.

Conditions Observed: Observed unapproved scoops fully submerged in bulk foods. Obtain approved scoops, with handles, and store with handles facing up, out of contact with the food to protect bulk foods from contamination.

ROACHY SAYS:

“Clean equipment, utensils, linens, and single-use articles shall be stored at least six inches above the floor in an approved location within the fully enclosed permitted food facility. Clean equipment, utensils, linens, and single-use articles shall not be exposed to splash, dust, vermin, or other forms of contamination. Non-food items shall be stored and displayed separate from food and food-contact surfaces. During pauses in food preparation utensils shall be stored with handles above the top of the food, on a clean sanitized surface, in running water, or in water that is at least 135øF. Single-use articles and multiservice utensils shall be handled, displayed, and dispensed so that contamination of food and lip-contact surfaces is prevented. Extra preset tableware shall be removed when a consumer is seated or cleaned and sanitized before further use. Pressurized cylinders shall be securely fastened to rigid structure. Linens must be free of food residue and soil and be laundered as required. 38. Adequate ventilation and lighting, designated areas, use.

Conditions Observed: Observed grease accumulation on ventilation hood. The ventilation hood and duct shall be serviced by a professional regularly to increase air flow and prevent a fire hazard. Observed non-functioning light in walk-in freezer and non-functioning lights in server station. Repair/replace lights to provide adequate lighting.

ROACHY SAYS:

“Approved exhaust hoods shall be provided to remove toxic gases, heat, grease, vapors and smoke. Canopy-type hoods shall extend six inches beyond all cooking equipment. Toilet rooms shall be consistent with local building codes and vented to the outside air by a screened openable window, air shaft, or light-switch activated exhaust fan. Adequate lighting shall be provided in all areas to facilitate cleaning and inspection. Light fixtures in areas where open food is stored, served, prepared, and where utensils are washed shall be of shatterproof construction or protected with light shields. 40. Wiping cloths: properly used and stored.

Conditions Observed: Observed wet wiping cloths stored without approved sanitizer solution. You may use a wiping cloth one time and then launder it, or you may use it multiple times if held in an approved sanitizer solution. Chlorine sanitizer solution was provided in sanitizer buckets for storage of wiping cloths. Thank you.

ROACHY SAYS:

“Wiping cloths used to clean food spills shall be used only once or stored in a sanitizing solution of an approved concentration as specified in section 114099.6. Dry or wet cloths that are used with raw foods of animal origin shall be kept separate from cloths used for other purposes, cloths that come into contact with raw foods of animal origin shall be kept in a separate sanitizing solution. Wiping cloths shall be free of food debris and visible soil. Working containers of sanitizing solutions for storage of in-use wiping cloths shall be used in a manner to prevent contamination of food, equipment, utensils, linens, or single-use articles. Wet wiping cloths shall be laundered daily. Dry wiping cloths shall be laundered as necessary to prevent contamination of food and clean serving utensils. (114135, 114185.1, 114185.3(d-e))”

41. Plumbing: proper backflow devices.

Conditions Observed: Observed keg refrigerators are draining into buckets. Equipment, such as refrigeration units, that discharge liquid waste shall be drained by means of indirect waste pipes through an air gap into a floor sink or other approved receptor. Observed condensate dripping from fan in walk-in refrigerator into a hotel pan. Repair.

ROACHY SAYS:

“Steam tables, ice machines, ice bins, food preparation sinks, display cases, walk-in refrigeration units, and other similar equipment that discharge liquid waste shall drain into a floor sink with an air gap or other approved type of receptor. All plumbing and plumbing fixtures shall be installed in compliance with applicable local plumbing ordinances, maintained so as to prevent any contamination, kept clean, fully operative, and in good repair. The potable water supply shall be protected with a backflow or back siphonage protection device. Any hose used for potable water shall be of approved materials, labeled, properly stored, and used for no other purpose. Liquid drain lines shall not pass through an ice machine or an ice storage bin. (114171, 114190, 114192, 114193, 114193.1, 114199, 114201, 114269)”

42. Garbage and refuse properly disposed; facilities maintained.

Conditions Observed: Observed debris (mattress) surrounding dumpsters. Maintain dumpster area clean.

ROACHY SAYS:

“The exterior premises of a food facility shall be kept free of litter and rubbish. All food waste and rubbish shall be kept in nonabsorbent, durable, cleanable, leak-proof, and rodent-proof containers. Containers shall have close-fitting lids and be covered at all times. All waste must be removed and disposed of as frequently as necessary to prevent the development of objectionable odors and other conditions that attract or harbor insects or rodents. 44. Premises; personal/cleaning items; vermin-proofing.

Conditions Observed: Observed large hole in exterior of the building. Repair hole. Observed non-functional equipment in the facility. Repair/replace/remove equipment that is no longer in use. Observed clothing and debris around building parameter. Maintain premises clean. Observed back door propped open during the inspection. Keep back door closed at all times, or install a screen to prevent entrance or harborage of animals, birds, or vermin.

ROACHY SAYS:

“All premises of a food facility shall be kept clean, fully operative, and in good repair. The premise of a food facility shall be free of litter and items unnecessary to the operation of the facility. Areas designated for employees to eat and drink shall be located so that food, clean equipent and utensils, linens, and single-use articles are protected from contamination. Personal items shall be stored in a designated area to prevent contamination of food or utensils. Food prep sinks, warewashing sinks, and handwashing sinks shall not be used for the cleaning or maintenance of tools or cleaning supplies or to dispose of mop water and similar liquid wastes. A dedicated janitorial sink with a drain shall be provided and conveniently located. A separate room, area, or cabinet shall be provided for cleaning supplies. The facility shall be kept vermin proof. Insect electrocution devices shall retain the insect within the device and shall not be located over food or utensil handling areas. 45. Floor, walls, and ceilings: built, maintained, clean.

Conditions Observed: Observed floors, walls and ceilings are in a state of disrepair throughout facility. Repair floors and coving, walls, and ceilings to provide a smooth, durable, nonabsorbent surface that is easy to clean. Submit manufacturer specification sheets and/or samples for approval prior to purchase and installation, if applicable.

ROACHY SAYS:

“Food facilities shall be fully enclosed in a building consisting of permanent floors, walls, and an overhead structure that meets minimum standards. The walls and ceiling shall be smooth, durable, nonabsorbent, and easily cleanable. Flooring and base coving shall be smooth, durable, and made of approved nonabsorbent material that is easily cleanable. Floor surfaces shall be coved at the juncture of the floor and wall with a 3/8 inch minimum radius and shall extend up the wall at least 4 inches.
