08. Proper hot and cold holding temperatures.
Conditions Observed: Au jus in countertop hot holding unit was measured at 58.6°F. Upon further inspection, it was discovered that the hot hold unit control knob had been accidentally turned all the way down. Corrected on site: au jus was immediately discarded (VCD) and unit was reset to correct temperature; thank you. Please monitor food temperatures in hot and cold holding units regularly to ensure that potentially-hazardous foods (PHF) held hot remain at or above 135°F and PHF held cold remain at or below 41°F at all times.
ROACHY SAYS:
“Except during preparation, cooking, cooling, transportation to or from a retail food facility for a period of less than thirty minutes, when time is used as the public health control, or as otherwise specified, potentially hazardous foods shall be maintained at or below 41F or at or above 135F. The following foods may be held at or below 45F: raw shell eggs, unshucked live molluscan shellfish, pasteurized milk and pasteurized milk products in original sealed containers, potentially hazardous foods held during transportation. Potentially hazardous foods held for dispensing in serving lines and salad bars may be held at 45F, not to exceed 12 hours in a 24 hour period, if unused portions are discarded. 20. Consumer advisory provided for raw or undercooked foods.
Conditions Observed: Burgers and other menu items are cooked to order, but no consumer advisory was included on the current menu. Facility has recently undergone a change of ownership and operator is actively updating the menu. Operator reports that the new menu has recently been sent to the printer and does include the required consumer advisory, but did not have a final copy of the new menu available for review at the time of the inspection. Please provide a copy of the updated menu with consumer advisory statement to this office by the comply-by date noted above in order to close this violation and avoid the need for an on-site reinspection; thank you.
ROACHY SAYS:
“If a food of animal origin is served raw, undercooked, or without otherwise being processed to eliminate pathogens, either in ready-to-eat form or as an ingredient in another ready-to-eat food, the permitholder shall inform consumers of the significantly increased risk of consuming those foods by way of a disclosure pursuant to subdivision (b) of 114093 and reminder pursuant to subdivision (c) of 114093, using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. 36. Equipment / Utensils approved; installed, clean, good repair, capacity.
Conditions Observed: Some items of equipment in the facility were either out of service or in disrepair. Specifically, the charbroiler on the cookline and the slicer in the kitchen prep area were out of service, and the walk-in freezer requires repair due to substantial ice buildup on the floor which poses a safety hazard. Please ensure that disused / out of service equipment is removed from the facility and that the walk-in freezer unit is repaired and functioning properly; thank you. Due to recent change of ownership, these items require compliance; see compliance schedule action plan for further details.
ROACHY SAYS:
“Utensils and equipment shall be kept fully operative and in good repair. All new and replacement equipment shall be properly installed and be certified or classified for sanitation by an ANSI accredited certification program. Electrical appliances must meet UL standards. Single-use articles shall not allow migration of deleterious substances or impart colors, odors, or tastes to food. Multi-use food contact surfaces must be smooth, free of breaks, chips, and similar imperfections; free of sharp internal angles, corners, and crevices; finished to have smooth welds and joints; be accessible for cleaning and inspection. Unless specified, wood and wood wicker may not be used as a food-contact surface. Unless specified, copper and copper alloys such as brass may not be used in contact with a food that has a pH below six or for a fitting between a backflow preventer and a carbonator. Beverage tubing and cold-plate beverage cooling devices cannot be installed in contact with stored ice intended to be used as food. Equipment that is not movable must be installed to allow for cleaning in place. Cutting or piercing parts of can openers must be readily removable. Facilities that wash, rinse, soak, thaw, or similarly prepare foods shall be provided with a approved food preparation sink. Reservoirs that supply water to produce foggers must be cleaned and maintained. Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced or replaced if they can no longer be effectively cleaned and sanitized. 42. Garbage and refuse properly disposed; facilities maintained.
Conditions Observed: Dumpsters were observed to be overflowing, with food and other debris on the ground that could attract vermin. Operator reports he has been having problems with the public using his dumpsters, and even cutting through chains he installed in an attempt to keep the dumpster lids closed. He states he has been having difficulty obtaining a locking dumpster from his garbage service provider. Please ensure that dumpster lids are secured (whether with locking lids, by installing a locking enclosure around the dumpsters, or other method) and that dumpsters are emptied frequently enough to prevent conditions that may attract vermin; thank you.
ROACHY SAYS:
“The exterior premises of a food facility shall be kept free of litter and rubbish. All food waste and rubbish shall be kept in nonabsorbent, durable, cleanable, leak-proof, and rodent-proof containers. Containers shall have close-fitting lids and be covered at all times. All waste must be removed and disposed of as frequently as necessary to prevent the development of objectionable odors and other conditions that attract or harbor insects or rodents. 44. Premises; personal/cleaning items; vermin-proofing.
Conditions Observed: Built-in cabinet units in the front service area had holes in the back panels, and one cabinet (under the small countertop bar sink) had a large panel cut out of the back. The wall behind this cut-out area had holes around plumbing fixtures that could permit entrance of vermin. In addition, the floor sink in this same area was partially covered by the cabinet unit, which rendered it inaccessible for cleaning. Please ensure that holes in wall and cabinet unit are sealed to prevent possible entrance of vermin and that floor sink is made accessible for cleaning. Food prep sinks, warewashing sinks, and handwashing sinks shall not be used for the cleaning or maintenance of tools or cleaning supplies or to dispose of mop water and similar liquid wastes. A dedicated janitorial sink with a drain shall be provided and conveniently located. A separate room, area, or cabinet shall be provided for cleaning supplies. Conditions Observed: Front handwash lacks single use paper towels. To be installed.
ROACHY SAYS:
“Handwashing facilities shall be provided within or adjacent to toilet rooms, food preparation, and warewashing areas. Handwashing facilities shall be clean, unobstructed, and accessible at all times. Handwashing facilities shall be provided with soap and sanitary single use towels in approved dispensers. ROACHY SAYS:
“Food-contact surfaces and utensils shall be clean to sight and touch. Food-contact surfaces and multiservice utensils shall be effectively washed, rinsed, and sanitized to remove or completely loosen soils by use of manual or mechanical methods. Precleaning may be required. Manual sanitization shall be accomplished during the final rinse by contact with solution containing 100 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. Mechanical sanitization shall be accomplished in the final rinse by achieving a utensil surface temperature of 160F or by contact with solution containing 50 ppm available chlorine, 200 ppm quaternary ammonium, or another approved sanitizer. After cleaning and sanitizing, equipment and utensils shall be air dried. Mechancial warewash machines must be approved and installed and operated according to manufacturer's specifications. Food contact surfaces, utensils, and equipment shall be cleaned and sanitized at the following times: before each use with different type of raw food of animal origin, when changing from raw food to ready to eat food, between uses with raw produce and potentially hazardous food, before using a thermometer, and any time during the operation when contamination may have occurred. Warewash sinks used to wash wiping cloths, wash produce, or thaw food must be cleaned and sanitized before and after these uses. Equipment, food contact surfaces, and utensils must be cleaned and sanitized throughout the day at least every four hours or as needed to prevent contamination. 22. Hot and Cold Water Available
Conditions Observed: hot water measured at 114F today. Adjust to 120 minimum.
ROACHY SAYS:
“An adequate, protected, pressurized, approved potable supply of hot and cold water shall be provided at all times. Hot water shall be supplied at a minimum temperature of 120F when measured from the faucet. The temperature of water provided to handwashing facilities shall be at least 100F. Handwashing facilities equipped with non-adjustable faucets shall have their temperature set between 100F and 108F. Hot water shall be provided at the food preparation sink and janitorial sink. 38. Adequate ventilation and lighting, designated areas, use.
Conditions Observed: Light bulbs over food prep/storage areas not shatter resistant. Replace with approved lighting.
ROACHY SAYS:
“Approved exhaust hoods shall be provided to remove toxic gases, heat, grease, vapors and smoke. Canopy-type hoods shall extend six inches beyond all cooking equipment. Toilet rooms shall be consistent with local building codes and vented to the outside air by a screened openable window, air shaft, or light-switch activated exhaust fan. Adequate lighting shall be provided in all areas to facilitate cleaning and inspection. Light fixtures in areas where open food is stored, served, prepared, and where utensils are washed shall be of shatterproof construction or protected with light shields. Conditions Observed: Bathroom doors lack self closing mechanisms. Add.
ROACHY SAYS:

Conditions Observed: Under building access lacks cover. fascia vent cover missing. Service windows are not screened or self closing and one has a broken pane. Correct these deficiencies.

45. Floor, walls, and ceilings: built, maintained, clean.
Conditions Observed: Rear dry storage has unfinished concrete. Seal with approved surface treatment. Front floor drain cover has insufficient clearance form cabinet for removal. Correct this deficiency. Sliding trays in cabinets are raw wood and lack smooth, easily cleanable surfaces. Modify these surfaces so as to be smooth and easily cleanable.

“Food facilities shall be fully enclosed in a building consisting of permanent floors, walls, and an overhead structure that meets minimum standards. The walls and ceiling shall be smooth, durable, nonabsorbent, and easily cleanable. Floor surfaces shall be coved at the juncture of the floor and wall with a 3/8 inch minimum radius and shall extend up the wall at least 4 inches.
