Round three! For today’s homework, LoCO asks you to wrap your brain around Proposition 36, which would reclassify some drug and theft crimes as felonies.
The measure is touted by proponents as a way to remedy some problems they say resulted from the passage of the decade-old Prop 47, which attempted to reduce California prison overcrowding by reducing some crimes to misdemeanors. Prop 36 would also introduce the concept of the “treatment-mandated felony” which would allow people charged with certain crimes to enter drug treatment in lieu of prison. Those who fail to complete their program would face incarceration.
