The Humboldt County Board of Supervisors is poised to approve new permitting restrictions for Kernen Construction’s controversial rock aggregate processing operation in Glendale. At Tuesday’s meeting, the board will consider several modifications to Kernen’s conditional use permit to address neighborhood complaints and environmental concerns at the site.

As we reported last week, neighbors of Kernen’s Glendale operation have filed a series of complaints over ‘round-the-clock noise, unshielded lights and alleged violations of environmental laws at the 37-acre site. The board held a public hearing in December to discuss permit revocation, but the hearing was cut short after Planning and Building Director John Ford announced that Kernen had made a settlement offer and asked to postpone the discussion.

The staff report attached to Tuesday’s agenda outlines several proposed changes to Kernen’s permit but does not mention a proposed settlement agreement. On the contrary, the report notes that there “has not been an agreed upon approach between staff and the permit holder.” The finer points of staff’s recommendation are outlined in the report at this link.

1. Hearing to Consider Revocation or Modification of a Conditional Use Permit Granted to Kernen Construction for a Rock Aggregate Processing and Materials Storage and Handling Yard Facility.

The Planning and Building Department is recommending to the Board of Supervisors that Kernen Construction’s Conditional Use Permit be modified to relocate a stormwater protection berm and add conditions for noise and operational hours. The department found that the permit was not being used according to its terms and conditions. Issues include unpermitted grading and noise disturbances. The proposal aims to address these issues while allowing Kernen Construction to continue its operations.

2. Project Trellis Local Equity Program Update and Community Equity Grant (CEG) Award

The Board of Supervisors of Humboldt County is facing a significant budget deficit and will not be getting a salary increase in 2025. They are focused on being financially responsible and serving the community. This decision will be formalized in the future.
