Jurors in the trial of murder suspect Jon David Goldberg asked today to hear a portion of Goldberg’s trial testimony and also the full testimony of prosecution witness Timothy Roscoe.

This afternoon the jury sent two notes to visiting Judge Graham Cribbs, one requesting a “copy” of Goldberg’s testimony about the trip from his Bridgeville home to the home of shooting victim Timothy Smith. A second note asked for the full testimony of Roscoe, who said he was involved in a “road rage” incident with Goldberg and saw him get out of his van at Smith’s home on Rohnerville Road.

Goldberg didn’t testify in detail about his trip to Smith’s house. He explained that without thinking, he put his gun in his vehicle with no intention to use it.

Goldberg said he left home about noon, drove to Fortuna at normal speed and got stopped in traffic a couple of times. He talked about his “destroyed” state of mind during the trip. He had learned hours earlier that Smith was having an affair with his wife. He denied he had any intention of killing Smith but was just planning to speak with Smith’s wife.

Goldberg said he strapped on his holstered gun when he realized Smith was home, thinking Smith might want to harm him.

Most of Goldberg’s testimony involved what happened at the end of the trip, when he encountered Smith outside and shot him five times.

Roscoe testified he encountered Goldberg on that trip. He said he was riding his motorcycle on Rohnerville Road when a mini-van pulled up so close behind him that “all I saw was the windshield.”

He pulled over to let the van pass, Roscoe said, and flipped the driver off as he sped by. He said the driver returned the favor.

Roscoe then followed the van until it pulled over at the Smith residence. He said the driver “jumped out and sprinted toward the house.”

Under questioning by the defense attorney, Roscoe said he saw nothing in the man’s hands. He waffled on that when being quizzed by the prosecutor, saying there may have been something in his hands but he couldn’t tell what.

Roscoe contradicted Goldberg’s statement about being stopped in traffic. In court he identified Goldberg as the van driver.

The court reporter read the requested testimony to the jurors, in the private jury room, late this afternoon.

Jurors also had another request for information, but Judge Cribbs closed the courtroom for that discussion and jurors weren’t there as they had left for the day. Both attorneys were in court, and apparently Goldberg.

The jury is expected to begin deliberating again tomorrow morning.
